These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Hoongry ("Company", "we", "us", or "our") regarding your access to and use of the Site and Marketplace Offers.
These Terms of Use constitute a legally binding agreement. By accessing the Site and/or using the Marketplace Offers, you confirm that you have read, understood, and agreed to all the terms described herein.
IF THE USER DOES NOT ACCEPT, IN WHOLE OR IN PART, these terms, they will not be able to use the Site or access the Marketplace Offers.
We reserve the right, at our sole discretion, to make changes or updates to these Terms of Use at any time. The changes will become effective as soon as they are published on the Site.
If any clause of these Terms of Use is deemed unlawful or ineffective, the validity of the remaining provisions will not be affected.
Unless otherwise indicated, the Site and Marketplace Offers are our exclusive property, and all source code, databases, functionalities, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are protected by copyright and other intellectual property rights. The Content and Marks are provided on the Site "AS IS" for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site or Marketplace Offers and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our express written permission.
Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access, solely for personal and non-commercial use. We reserve all rights not expressly granted to you in the Site, Content, and Marks.
By using the Site or Marketplace Offers, you declare and warrant that: (1) you have the legal capacity and agree to comply with these Terms of Use; (2) you are not a minor in the jurisdiction where you reside; (3) you will not access the Site or Marketplace Offers through automated or non-human means, such as bots, scripts, or otherwise; (4) you will not use the Site for illegal or unauthorized purposes; and (5) your use of the Site or Marketplace Offers will not violate any applicable law or regulation.
If you provide false, inaccurate, outdated, or incomplete information, we have the right to suspend or close your account and refuse any current or future use of the Site (or any part thereof).
The user may not use the Site or Marketplace Offers for illegal or unauthorized purposes, nor, in the use of the Marketplace Offers, violate any law. Unauthorized marketplace offers include the following: intoxicating substances of any kind; illegal drugs or other illegal products; gambling; and pornographic or graphic adult content, images, or other adult products. Posting any unauthorized product or content may result in the immediate closure of your account and a lifetime ban from using the Site. We are a service provider and do not make any representations regarding the safety, efficacy, suitability, accuracy, availability, pricing, ratings, reviews, or legality of any information contained on the Site or Marketplace Offers displayed or offered through the Site. You understand and agree that the content of the Site does not contain or constitute a representation on which you can reasonably rely, and you agree to hold us harmless from any errors, omissions, or misrepresentations contained on the Site. We do not endorse or recommend any marketplace offer, and the Site is provided for informational and advertising purposes only.
We make every effort to display as accurately as possible the colors, features, specifications, and details of the Marketplace Offers available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the Marketplace Offers are accurate, complete, reliable, up-to-date, or free from other errors. All Marketplace Offers are subject to availability, and we cannot guarantee that the Marketplace Offers will be available. Some Marketplace Offers may be available exclusively online through the Site. Such Marketplace Offers may have limited quantities and are subject to return or exchange only in accordance with our Return Policy.
We reserve the right to limit the quantities of Marketplace Offers available on the Site. All descriptions or prices of Marketplace Offers are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any Marketplace Offer at any time and for any reason. We do not guarantee that the quality of the Marketplace Offers you purchase will meet your expectations or that any errors on the Site will be corrected.
We accept the following forms of payment: Credit cards via Stripe.
You agree to provide current, complete, and accurate purchase and account information for all purchases of Marketplace Offers made through the Site. You also agree to promptly update your account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as required by us. We may change prices at any time.
You agree to pay all charges at the prices in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment service provider for such amounts at the time of placing the order. We reserve the right to correct any errors in pricing, even if we have already requested or received payment.
We reserve the right to refuse any order placed through the Site. We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or through the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers or distributors.
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those specifically approved.

The Site does not offer users the ability to submit or post content. We may provide you with the opportunity to create, submit, post, display, transmit, perform, distribute, or transmit content and materials to us or on the Site, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). Contributions may be viewable by other users of the Site and through third-party websites. Therefore, any Contributions you transmit may be treated in accordance with the Site's Privacy Policy. Any use of the Site or Marketplace Offers in violation of the above constitutes a breach of these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site and Marketplace Offers.
By agreeing to these Terms of Use, you authorize us to access, store, process, and use any information and personal data you provide, in accordance with the terms of the Privacy Policy.
By submitting suggestions or other feedback regarding the Site, you also authorize us to use and share such feedback for any purpose without compensation.
We do not claim ownership of your Contributions. You retain full ownership of all your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not responsible for any statements or representations you provide on the Site. You are solely responsible for your Contributions and expressly agree to exonerate us from any liability and to indemnify and hold us harmless from any legal action that may be directed at us due to the content of your Contributions.
We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including, without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site and Marketplace Offers.
Pursuant to Article 1456 of the Italian Civil Code, we have the right to terminate the contractual relationship with the user and suspend the user's right to use the Site, immediately, by written notice (including via email), in the following cases:
Upon termination or suspension, the user is required to immediately destroy any excerpt of the Site that may have been downloaded or printed.
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our site. We also reserve the right to modify or discontinue all or part of the Marketplace Offers without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or Marketplace Offers.
We cannot guarantee that the Site and Marketplace Offers will always be available. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site or Marketplace Offers at any time or for any reason without notice. We disclaim any liability for any loss, damage, or inconvenience caused by your inability to access or use the Site or Marketplace Offers during any period of downtime or interruption of the Site or Marketplace Offers. Nothing in these Terms of Use will be construed to obligate us to maintain and support the Site or Marketplace Offers or to provide any corrections, updates, or releases in connection therewith.
All claims and disputes arising out of or in connection with these Terms of Use of the Site will be governed and interpreted in accordance with Italian law. For consumers residing in Italy, the mandatory consumer protection provisions of Italian law (Consumer Code) will apply.
Any dispute arising from these Terms of Use of the Site will be subject to the exclusive jurisdiction of the courts of Verona. In the case of disputes arising from these Terms of Use of the Site involving consumer users, consumers may bring proceedings in (i) the courts of Verona or (ii) the courts of their place of residence or domicile in Italy.
In the event of a dispute, the user is encouraged to first contact Customer Service to find a solution.
We will not be liable to users under any circumstances, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, even if foreseeable, arising out of or in connection with the Site (including use, inability to use, or the effects of use of the Site) in relation to:
Subject always to applicable consumer protection laws, our liability to users in relation to any other loss arising out of or in connection with the Site or its use by the user, whether in contract, tort, for breach of statutory duty, or otherwise, shall not exceed the amount between twice the value of the Order and an amount equal to €100.
We provide the user with access to the Site and allow its use on the assumption that, to the maximum extent permitted by law, all warranties, representations, conditions, undertakings, and any other terms in relation to the Site and its use by the user (including any representation, warranty, condition, undertaking, or other provision that may otherwise apply to the Site or its use by the user, or that is impliedly made applicable or included in these Site Terms under applicable law or otherwise) are excluded.
We do not provide any warranty regarding the accuracy or completeness of the content of the Site or the content of any linked website and will not be liable for any:
We do not warrant, endorse, or assume responsibility for any product or service advertised or offered by a third party through the Site.
We will retain some data you transmit to the Site for the purpose of managing the performance of the Marketplace Offers, as well as data related to your use of the Marketplace Offers. Although we perform regular routine backups of data, you are solely responsible for all data you transmit or that relates to any activity you have undertaken using the Marketplace Offers. Accordingly, you release us from any liability for any loss or damage to such data and waive any right of action against us arising from such loss or damage.
Applicable law may require that some of the information and notices we provide to you must be communicated in writing. By using the Site or placing Product Orders through the Site, you agree that communication will primarily occur electronically. In particular, you agree to be contacted by email or to be provided with information through the posting of notices on the Site. For contractual purposes, you agree to such electronic means of communication.
These Terms of Use and any policies or operating rules posted by us on the Site or in relation to the Marketplace Offers constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision of these Terms of Use is determined to be unlawful, void, or unenforceable, such provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.

The user, pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, expressly approves the following articles: 3 (User Representations); 6 (Prohibited Activities); 7 (User-Generated Contributions); 10 (Dispute Resolution); 11 (Governing Law and Jurisdiction); 13 (Disclaimers and Limitations of Liability); 15 (Written Communications).
Truthfulness of Information: The user is required to provide truthful information during registration. Hoongry reserves the right to verify the truthfulness of this information.
Limitation or Deletion of Profile: In the event of non-cooperation by the user or if Hoongry suspects that the information provided is untruthful or contains material that violates the terms and conditions of service, Hoongry reserves the right to limit or delete the user's profile.
Order Responsibility: The user is responsible for the order placed through the Hoongry app and agrees to inform the restaurant of any cancellation of the order.
Intermediation Function: Hoongry is only an intermediary between the restaurant and the customer and therefore has no responsibility in relation to the orders placed.
Allergens: The user is required to provide accurate information about any food allergies or intolerances at the time of ordering. The restaurant undertakes to take the necessary precautions to avoid accidental contamination but cannot guarantee the total absence of allergens in its products.
Availability: Products and prices published on the online menu may be subject to change without notice. The restaurant undertakes to keep its menus updated but cannot guarantee the availability of all products at all times.
Prices: The restaurant undertakes to maintain accurate and consistent prices with those published on the online menu. In case of errors or inconsistencies, the restaurant reserves the right to correct them without notice.
Delivery: The restaurant undertakes to deliver orders within the expected time. In case of delays or issues with delivery, the user may contact Hoongry for assistance. If the user is not available at the time of delivery, the restaurant is not obliged to make another attempt and no refund will be provided.
Address Change: If necessary, the user may request a change of address for delivery. However, neither Hoongry nor the restaurant can guarantee that such a change will be made. The user is required to communicate any address changes to Hoongry as soon as possible.
Pickup: If the user has opted for pickup, they are required to collect the order within the expected time. In case of delay or failure to collect, the restaurant is not obliged to maintain the availability of the order and no refund will be provided.
If the user continues to fail to show up for pickup, uses fake addresses, or does not show up during delivery, Hoongry may take action on their account, limiting or revoking their functionalities, or permanently closing the account.
If the user receives a wrong order, it is important that they notify both the restaurant and Hoongry as soon as possible.
Hoongry and the restaurant will collaborate to resolve the situation as quickly as possible.
If the error in preparing the dish is attributable to the restaurant, it will be responsible for replacing the dish or issuing a refund, if necessary.
The user is required to communicate the cancellation of the order within the minimum notice period set by the restaurant.
To cancel, the user must use the Hoongry website or mobile application.
In case of cancellations made outside the notice period, Hoongry or the restaurant may not accept the cancellation or issue only a partial refund.
In case of technical issues related to the Hoongry platform, the user is entitled to a full refund of the order.
If the user cancels the order before the minimum notice period, they will be entitled to a full refund. Otherwise, Hoongry and the restaurant cannot guarantee that the refund request will be accepted.
The customer is entitled to a full refund if they cancel a pending order even after the minimum notice period.
If the request for a full refund is accepted, it will be issued according to the payment method chosen by the user. For more information, please refer to the "Payments and Refunds" section.
The restaurant will attempt to deliver or prepare the order within the expected time.
In case of delays or failure to deliver, the user may contact Hoongry or the restaurant for more information.
Hoongry and the restaurant will do their best to resolve the situation, which may include issuing a refund or credit for a future order, also in the form of Hoopoints.
Booking Responsibility: The user is responsible for the booking made through the Hoongry app and agrees to inform the restaurant of any cancellation.
Intermediation Function: Hoongry is only an intermediary between the restaurant and the customer and therefore has no responsibility in relation to the bookings made.
Modification or Cancellation of Booking: Both Hoongry and the restaurant have the right to modify or cancel the booking without notice or justification.
Respect of Booking Times: The user is required to respect the notice periods set by the restaurant regarding the communication of the booking time and its cancellation.
Consequences for the User: The user's account may be subject to repercussions in case of cancellation of the booking beyond the set times or in case of non-compliance. Hoongry has the right to limit or delete the user's account in case of misuse towards Hoongry or partner restaurants.
Hoongry provides only an intermediary between the customer and the restaurant and will not be responsible for any issues or disputes related to the booking. The responsibility for such matters will rest solely with the restaurant.
It is prohibited to create fake bookings or with the intention of causing damage to Hoongry or partner restaurants. The user agrees to be solely responsible for the bookings made through the use of the Hoongry app. In case of shared bookings, the owner of the shared menu and therefore the user who creates the booking will be responsible.
Bookings with Order:
Order Communication During Booking: The user may enter the dishes they wish to eat during the booking process or after submitting the booking.
Restaurant Responsibility: The restaurant is not obliged to prepare the dishes selected by the user during the booking.
Notice Utility: This booking with order functionality is for informational purposes only and does not guarantee that the selected dishes will actually be available at the time of the meal.
Order Modification at the Restaurant: Once at the restaurant, the order may vary at the user's discretion.
Prices and Availability: Prices and availability of dishes are the responsibility of the restaurant, and Hoongry cannot be held responsible for any variations or shortages.
Prohibition of Incorrect Use: It is prohibited to use this function to create fake bookings. The user's account may be limited or deleted in case of misuse of this function by the user.
Users booking with a maximum advance of four days will be required to enter their credit card number as a guarantee for the booking, if the restaurant requests it.
From the booking date, the user will have one day to enter their credit card details as a guarantee, after which the booking will be considered canceled.
The user must provide accurate credit card information and must be the actual cardholder. Therefore, the user is not allowed to provide a fake, insufficient, or stolen credit card.
Credit card management is handled by Stripe. Hoongry has NO role in such transactions. For further details, please refer to Stripe's terms and conditions.
The charge on the credit card is managed by the restaurant, NOT by Hoongry, which disclaims any responsibility for the amounts charged by the restaurant and for any related disputes.
Hoongry is a mere intermediary acting on the instructions and impulse of the restaurant, which is solely responsible for charges, blocks, or refunds.
The user may not bypass Hoongry's computer systems to avoid entering their credit card if it is required to book at the chosen restaurant.
If the restaurant requires a credit card as a guarantee for a booking, the user may not refuse to provide it.
In case of non-compliance with the booking, delay beyond the terms defined by the restaurant, or failure to communicate the absence of guests, the user authorizes the restaurant to send instructions to the card issuer to charge the payment as agreed at the time of booking.
The funds may remain blocked for up to a maximum of 7 days from the booking date and may be unblocked immediately by the restaurant in case of confirmation of visit or cancellation of the booking.
No charge will be made if the customer respects the booking or if the delay or failure to show up is due to force majeure not attributable to the customer.
The penalty price displayed in the app is to be understood as a per-person price. Any transaction fees are the user's responsibility.
The customer is entitled to a full refund of the penalty in case of erroneous charge by the restaurant. The refund will be processed using the same payment method used for the booking. The refund is managed by the restaurant and Stripe, NOT by Hoongry, which disclaims any responsibility for the amounts refunded and for any related disputes.
Hoongry reserves the right to verify the accuracy of the information provided by the user.
In case of violations, Hoongry may limit or block the user's access to the platform.
The user agrees to receive notifications and reminders related to the booking.
The user is obliged to keep their credit card information updated.
The user may contact Hoongry support for any clarification or issue related to the credit card guarantee.
The user agrees that the penalty amount may vary depending on the restaurant and booking preferences.
Hoongry guarantees that all credit card information provided by the user will be treated with the utmost confidentiality and in compliance with applicable data protection laws.
The user has the right to access, modify, or delete their personal information at any time through their account settings.
Payment Option: The customer will have the option to pay the bill in-app via Hoopay.
Request to Send: To be able to pay in-app, the user must expressly ask the restaurant to send the Hoopay.
Payment Options: Once the Hoopay is received, the user may decide how to pay their bill. They may split it and pay via credit card, at the cashier, or with Hoopoints. For more information, please refer to the "Payments" section of the terms and conditions.
User Responsibility: The user is required to immediately notify Hoongry of the restaurant if the total of the Hoopay does not match the total of the bill.
Refund: In case of payment made by mistake, the user may request a refund according to the methods provided in the 'Payments-Refunds' section of the terms and conditions. However, in case of delayed notification as per point 4, the refund will not be guaranteed. It is therefore important that the user carefully checks the total of the Hoopay before proceeding with payment.
Definition of Hoopoints: Hoopoints are virtual points in the Hoongry system that can be accumulated and used as currency on the platform.
Hoopoints/Currency Conversion: 100 Hoopoints equal 1 euro. This conversion is fixed and not subject to change.
Acquisition of Hoopoints: Each user has the opportunity to earn Hoopoints by sharing their unique code with restaurants. If a restaurant registers through the user's code, the user will receive 4000 Hoopoints.
Activation Bonus: After the restaurant's registration, 500 Hoopoints will be immediately credited to the user's account. The remaining 3500 Hoopoints will be credited one month later if the restaurant remains active on the platform.
Prohibition of Spamming: Misusing the referral code, such as spamming, is prohibited. In case of violation of this rule, Hoongry has the right to limit or remove the user's profile.
Payments via Stripe: the customer accepts Stripe's terms and services regarding payments. In case of technical issues with the payment system, the responsibility lies with Stripe.
Payments via Hoopoints: the customer will have the option to pay in full or partially with Hoopoints at restaurants where the service is active. Partial payments with Hoopoints can only be used for payments made on the Hoongry platform via Stripe. The customer is responsible for managing and safeguarding their Hoopoints.
Cash or Cashier Payments: the customer will have the option to pay in cash or at the restaurant's cashier. The responsibility for any issues with the payment lies with the restaurant.
Refunds:
In case of entitlement to a refund, the customer may receive the total or partial amount based on the agreements made with the Restaurant or Hoongry.
In case of entitlement to a full refund, the customer may receive the total amount using the payment method used to complete the purchase. The time required for the refund may vary depending on factors such as Stripe, the customer's bank, and the banking circuit involved. However, Hoongry is committed to working as quickly as possible to complete the refund process and provide the customer with the total amount as soon as possible. The customer is responsible for providing accurate and complete information regarding their payment method to ensure a smooth refund process.
Disputes:
In case of disputes regarding payments, the customer has the responsibility to first contact the restaurant or Hoongry to resolve the issue. If a satisfactory solution cannot be found, the customer may open a dispute on Stripe, which will be handled according to the terms and procedures provided by Stripe for resolving payment-related disputes. The time for dispute resolution may vary depending on Stripe, the bank, and the financial circuit involved.
Hoongry may have a say in disputes between the customer and the restaurant and may influence the outcome of the dispute. However, Hoongry will not be responsible for any losses or damages suffered by the customer during the dispute. The customer agrees that the final outcome regarding the dispute will be binding on both parties.
Hoongry's customer service team is always available to assist customers with any questions or issues. The customer can contact customer service via email or contact form on Hoongry's website. The customer service team will do their best to respond within a reasonable time and resolve any issues.
In case of disputes with the restaurant, the customer is encouraged to first contact Hoongry's customer service, which will attempt to find an amicable solution. If the dispute cannot be resolved in this way, the customer may follow the dispute procedure described in the 'Payments' section of these terms and services.
The customer agrees that Hoongry will not be responsible for any losses or damages suffered during contact with customer service or during the resolution of disputes.
Hoongry's customer service is available during normal business hours and will attempt to respond to requests as soon as possible. However, there may be waiting times during periods of high request volume.
Users registered on Hoongry may review restaurants only if they have actually ordered and booked at the restaurant in question.
User reviews will be subject to verification by Hoongry to ensure their quality and truthfulness.
Hoongry reserves the right to delete, without notice or justification, any review that violates the terms and conditions or is contrary to the law.
Users are encouraged to respect Hoongry's community guidelines and not to post offensive or defamatory comments.
Hoongry is not responsible for the content of user reviews and does not guarantee the accuracy or truthfulness of the information published. Users are fully responsible for the content of their reviews.
The user is aware and acknowledges that the publication of illegal content may result in legal action against them.
It is prohibited to create fake reviews or with the intent to damage Hoongry or the reviewed restaurant. Any such behavior may be subject to sanctions and legal action.
Users agree to receive promotions from Hoongry or from restaurants through Hoongry if they have chosen to accept this option in the app.
Users may modify their choices regarding receiving promotions at any time through the tools provided in the app or by contacting Hoongry.
Hoongry is not responsible for the promotional content of restaurants sent to users, regardless of their choice to receive promotions.
Users may confirm their receipt of promotions to help us monitor the quality of our marketing campaigns.
Hoongry reserves the right to modify or delete promotions at any time and without notice to adapt them to the needs of our users and our business partners.
Users are prohibited from sharing promotions with third parties without Hoongry's prior consent.
Hoongry provides information on the restaurants present on the platform but cannot guarantee the accuracy and completeness of this information. Users are encouraged to verify the validity of the information provided by restaurants before placing an order or making a booking.
Hoongry will not be responsible for any errors or inaccuracies by restaurants, such as menu descriptions, prices, opening hours, etc.
Users are encouraged to contact restaurants directly in case of questions or issues related to the information provided.
Hoongry will not be responsible for any damages or losses suffered by the user as a result of an error by the restaurant, such as the delivery of a wrong order or the booking of an unavailable table.
Hoongry will not be responsible for any changes to the information provided by restaurants, such as changes to menus, prices, opening hours, etc.
This disclaimer section is governed and interpreted in accordance with Italian law.
Hoongry does not guarantee the continuous and uninterrupted availability of the service. Temporary interruptions may occur for maintenance or technical issues.
Hoongry does not guarantee that the service is error-free or that it will meet the users' needs. Users are encouraged to provide feedback to help improve the service.
